Welcome to mind-n. These Terms of Use (‘Terms’) govern your access to and use of the mind-n platform, including the website, mobile and desktop applications, and any related services (collectively, the ‘Service’) operated by Witmer Execution Labs Pvt Ltd (‘Witmer’, ‘we’, ‘us’, or ‘our’).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not access or use the Service. These Terms constitute a binding agreement between you and Witmer.

We may update these Terms from time to time. The ‘last updated’ date at the top of this page reflects the most recent revision. Material changes will be communicated to registered users by email or in-product notification at least thirty days before they take effect.

mind-n is an Execution Intelligence platform that provides tools, diagnostics, and recommendations to help delivery teams handle friction and improve operational outcomes. The Service includes the Execution DNA assessment, the n-Coach intelligence layer, the Gym (a library of structured tools), and expert-led Masterclasses.

The Service is provided on a beta basis during the period preceding general availability. Beta features may change, be removed, or be augmented at our discretion. We will give reasonable notice before discontinuing any feature that materially affects your use.

To access certain features of the Service, you must create an account. You agree to provide accurate, current,and complete information during registration and to update such information to keep it accurate and complete.

You are responsible for safeguarding the password and credentials associated with your account. You agree not to disclose your password to any third party and to notify us immediately of any unauthorized use of your account.

Witmer reserves the right to refuse, suspend, or cancel registration for accounts that violate these Terms or that we reasonably believe have been used in connection with prohibited activities.

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service in any way that violates applicable laws or regulations, infringes the rights of others, or interferes with the operation of the Service.

Prohibited activities include but are not limited to: reverse-engineering or attempting to extract the source code of the Service; using automated means to access the Service without authorization; transmitting malicious code or content; impersonating any person or entity; and using the Service to generate or distribute spam or unsolicited communications.

The Service and its original content, features, and functionality are owned by Witmer Execution Labs Pvt Ltd and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Subject to your compliance with these Terms, Witmer grants you a limited, non-exclusive, non-transferable,non-sublicensable license to access and use the Service for your internal business purposes during the term of your subscription or pilot engagement.

Any content you submit to the Service, including responses to the Execution DNA assessment and inputs ton-Coach, remains your property. By submitting content, you grant Witmer a limited license to process and store that content for the purposes of operating the Service and improving the underlying algorithms.

Our collection and use of personal information in connection with the Service is described in our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of information as described in the Privacy Policy.

Witmer maintains ISO 27001 certification and complies with applicable data protection regulations, including the General Data Protection Regulation (GDPR) for users in the European Economic Area and the Digital Personal Data Protection Act for users in India.

Certain features of the Service are made available on a paid subscription basis. Subscription fees, billing cycles, and the features included in each subscription tier are described at the point of purchase.

Unless otherwise stated, all fees are quoted exclusive of applicable taxes. You are responsible for any taxes,duties, or government charges associated with your use of the Service. Fees are non-refundable except as required by applicable law or as expressly stated in these Terms.

We may change our subscription fees from time to time. Fee changes for existing subscriptions will take effect at the start of the next billing cycle following at least thirty days’ written notice.

You may terminate your account at any time by contacting us at the address provided at the end of these Terms.Witmer may suspend or terminate your access to the Service for breach of these Terms, prolonged inactivity, or as required by law.

Upon termination, your right to access the Service will cease immediately. Provisions of these Terms that by their nature should survive termination shall survive, including intellectual property rights, disclaimers,limitations of liability, and dispute resolution provisions.

The Service is provided ‘as is’ and ‘as available’ without warranties of any kind, either express or implied.Witmer does not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

The Execution DNA assessment is a diagnostic tool intended for indicative purposes. It is not formally validated and should not be relied upon as a definitive measure of individual or team capability. Insights,recommendations, and tools provided by n-Coach are guidance, not professional advice.

To the maximum extent permitted by applicable law, in no event shall Witmer Execution Labs Pvt Ltd, its directors, employees, partners, or agents be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Service.

Our total cumulative liability arising out of or relating to these Terms or the Service shall not exceed the greater of the fees paid by you to Witmer in the twelve months preceding the event giving rise to the claim, or one hundred US dollars (USD 100).

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Bengaluru, Karnataka.

Before initiating formal proceedings, the parties agree to attempt in good faith to resolve any dispute through direct negotiation for a period of at least sixty days.

We may revise these Terms at any time by updating this page. Material changes will be communicated to registered users via email or in-product notification at least thirty days before the changes take effect. Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of the changes.
